PROVIDENT FUND CLAIM

If you have submitted all the papers for withdrawal of your PF to the Provident Fund office where your PF account is maintained and payment is being inordinately delayed or bribe is being demanded or you are harassed by the employees of PF office take following steps:

1. File application as per format annexed hereunder with the Central Public Information Office of the PF office, where you are maintaining account.

2. Enclose Indian postal order of Rs10/- [available at nearby post office] in favour of “Accounts Officer, EPFO” or “Commissioner of PF, EPFO” and made payable at the place where your application is sent.

3. Enclose list attached to the application hereunder after filling the blanks.

4. Enclose self attested photocopy of application for withdrawal of provident fund, which was earlier submitted to the PF office.


5. Mail by speed AD post. Avoid courier/hand delivery. Usually RTI applicants are not welcome at govt. offices.

6. Carefully retain postal proof of mailing, AD and official acknowledgement if received.

7. Remit the amount to CPIO when requested by CPIO by bank draft/pay order/IPO towards photocopying charges @Rs.2/- per A-4 size paper if you have asked for copies of record etc. Information on CD will cost Rs.50/- per CD.

8. You should get reply within 30 days of receipt by the addressee as per RTI act. If you do not receive reply within 40 days of mailing RTI application, [including 10 days for postal transit], file first appeal under RTI act. You have 60 days time from the date of mailing RTI application for filing first appeal.

9. If you receive reply and are not satisfied with it, then within 30 days of receipt of reply by you, you should file first appeal.

10. You should get reply of first appeal within 40 days of mailing it including postal delay. If you are not satisfied with result of first appeal, file second appeal within 90 days from receipt of reply of first appeal or when you should have received reply, if no reply is received.

11. It is advisable to consult local RTI NGO/activists or visit my
blogs of jps50 on www.rtiindia.org web site for filing first and second appeals under RTI Act 2005, for better results. Consultation is normally free as a social service.

12. Please visit www.epfindia.nic.in for address and rules etc.

13. All the best and be part of improving the way we are governed by using RTI Act, the best piece of legislation ever made since 1947 for empowering common citizen of this great country. This is journey of common man from BECHARA TO MALIK through RTI.

In one case, settlement of PF was being delayed for two years. RTI application was filed and within 28 days got the cheque with interest for delay. Try for you, RTI will work.

3. I be informed details of action so far taken by your office for recovering arrears if any of employers’ contribution in my account and the result of such action. If no action is taken, I should be informed reasons thereof and names, designation and place of present posting of officers responsible for the same.

4. I be kept informed of progress and action taken against employer/s by your office for recovery of arrears of their contribution to my P.F. a/c on calendar quarterly basis.

5. Details of daily progress made on my said withdrawal application from date of receipt by your office till date of your reply.

6. Names, designations and office addresses of the officials with whom my said application was lying during this period and date wise period with each official and details of action taken by him/her.

7. Please give evidence of receipt and dispatch of my application in the offices of each of these officials.

8. Please inform me, according to your rules or citizens charter or any other order, number of days in which such a matter should have been dealt with and resolved. Please also provide a copy of these rules.

9. If the officials/employees have not adhered to the time limit mentioned in rules and are guilty of violating these rules, please give a copy of their conduct rules and details of action taken by the controlling authority against erring officials/employees.

10. In case no action has been initiated for dereliction of duties against erring officials, the reasons be made known to me, with name, designation, address and contact details of controlling authority of these officials/employees.


11. Please let me know when I am likely to receive my full PF dues.

12. Please provide me certified photocopy of file notings held on my said application.

13. Please inform me number of complaints which were received against your office in last one year or last financial year for delay in settlement of PF dues.

14. Please inform me number of employees of your office against whom disciplinary/departmental action was initiated in last one year or in last financial year for dereliction of duties, corruption, minor or major misconduct, breach of rules, non adherence to service rules etc.

  1. As discussed in point2)about fee(Rs.10/=), is it acceptable through DD instead of PO.In my area, PO is not availbale since long in Post office.And Should DD be in same favour?
